Appeals policy

1. Introduction
This Policy forms part of your agreement with us. Here are a few key things to note:

• You must follow the procedures below to appeal a content or account moderation decision, or to request content removal if you are a person depicted in the content and wish for it to be taken down.
• dFans will handle appeals and takedown requests in keeping with this Policy.

3. Interpretation
Unless specifically defined in this Policy, the meanings given to words defined in the Terms of Use have the same meanings.

4. "Decision"
Any action taken by dFans to:

• Suspend or deactivate an account;
• Suspend or deactivate content shared to or from an account;
• Impose a final warning for a violation on an account;
• Restrict account features (e.g., messaging);
• Suspend, terminate, or restrict the ability to monetise content (e.g., subscriptions or payment acceptance);
• Refuse to remove content at the request of a person depicted in that content.

5. Takedown Requests by Depicted Persons
Any individual who appears in content hosted on dFans may submit a request to have that content reviewed and potentially removed, if they believe:

• They did not provide valid and informed consent for the content to be posted; or
• That their previously given consent is void under applicable law (e.g., due to age, coercion, or withdrawal of consent).

If, upon review, dFans determines that valid consent was not given, or is void under law, the content will be promptly removed.

6. Neutral Dispute Resolution
In the event of a disagreement about whether content should be removed, dFans will allow such disagreements to be resolved by a neutral third party or adjudicative body, as applicable.
We do not make such determinations unilaterally in cases of contested consent or takedown validity.

7. Use of Policy
This Policy applies to:

• dFans users who want us to review or reverse a Decision; and
• Non-users (including persons depicted in content) who wish to appeal or request takedown of content they are featured in.

8. Appeal and Takedown Procedure
The only way to initiate an appeal or takedown request is by completing and submitting the Deactivation Appeal Form.

9. Required Information
Only fully completed Deactivation Appeal Forms will be considered. Your submission must include:

• The username or URL of the account;
• The URL of the content in question;
• Your relation to the content (e.g., subject, rights holder, or account owner);
• Detailed reasons for appeal or takedown, including any evidence regarding consent or its revocation;
• If you are not a dFans user, the basis for believing the content should be removed (e.g., illegal, non-consensual, or otherwise harmful).

10. Timing of Appeals
All appeals or takedown requests should be submitted within six (6) months of the original Decision or publication.

11. Review Process
If we receive a completed Deactivation Appeal Form:

• We will review the dFans account and content in question;
• Consider the supporting information and documents provided;
• We may request additional documents or verification from you or third parties;
• Based on our investigation or, if applicable, a neutral body’s decision, we will grant, partially grant, or deny the appeal or takedown request.

12. Results

• If fully granted: the Decision or content will be reversed or removed;
• If partially granted: you will be notified of specific actions taken;
• If denied: no changes will be made, but your right to neutral review will remain open if applicable.

13. No Liability
We are not liable for any temporary or permanent interruption of access to a dFans account, including any resulting loss of income or subscribers, regardless of appeal outcomes.

14. Appeals Team
Our Appeals Team will evaluate all appeals and takedown requests in a non-discriminatory, diligent, and neutral manner.

15. Irreversible Decisions
This Policy does not apply to irreversible Decisions that fall outside the scope of content moderation or depicted-person takedowns.
